Imlay Township Board Meeting

 

Imlay Township Hall            Wednesday May 17, 2006                 7:30p.m.

 

Members Present:  Supervisor Steve Hoeksema, Treasurer, Debra Burns, Clerk Dawn Childers, Trustee Larry Kennel, and Trustee John Mulder. 

 

Others Present:  Attorney Gary Davis, Building Inspector Paul Wilcox, Recording Secretary Jessica Kirchoff, and members of the public per attached sheet. 

 

  1. Call to Order:  Supervisor Steve Hoeksema called the meeting to order at      7:30 p.m. and the Pledge of Allegiance was recited. 

 

  1. Roll Call:  Recording Secretary Jessica Kirchoff called the roll.

 

  1. Minutes:  The Board reviewed the minutes of the Wednesday April 19, 2006 meeting. 

 

Moved by Larry Kennel, supported by John Mulder, to accept the minutes of April 19, 2006 with corrections made to the total amount of the bills paid for April.  Motion Carried. 

           

            The Board reviewed the minutes of the May 3, 2006 work session.

Moved by Larry Kennel supported by Dawn Childers to accept the minutes of the May 3, 2006 work session as presented.  Motion Carried. 

 

  1. Treasurer’s Report:  Treasurer Debra Burns submitted her report.      

 

Moved by Dawn Childers, supported by Larry Kennel, to accept the Treasurer’s report as presented.  Motion Carried. 

 

 

  1. Planning Commission Report:  Trustee Kennel reported that the planning commission held several public hearings for draft amendments concerning weed control, inspection of Mining Reclamation, and landscaping.  Also they re-reviewed and approved the Hahn Drive development.   

 

  1. Public Time:  None

 

7.  Old Business:  A. Hahn DriveThe new drainage plan was approved by the planning commission. The Board is still concerned about surrounding neighbors and will wait until a representative from the project is present to answer questions. 

 

Moved by Larry Kennel, supported by Dawn Childers, to table this issue until a representative from the project is present for a better understanding of the drainage route details.  Motion Carried.

 

B.     Mud Bog – Mud Bog competitions are not permitted in an Agriculture Zoned area.  The property owners have been notified of this violation last season and continue to host mud bogs.  Attorney Davis recommends action to be taken with a circuit court conjunctive order.    

 

Moved by Debra Burns, supported by Larry Kennel, to authorize Attorney Davis to file a Circuit Court Conjunctive Order to stop Mud Bog competitions.  Motion Carried. 

 

 

8.  New Business:  A. Road Millage – To be placed on the August Primary with an option of 1 mill for maintenance and 2 mills for maintenance and improvements. 

 

Moved by Larry Kennel supported by John Mulder, to put a road millage on the August Primary with an option of 1 mills for road maintenance, and 2 mills for road maintenance and improvement to be collected for a period of 5 years.  Motion Unanimously Carried. 

 

B.     OEFMP Fund Millage – Has expired.  Need to renew.

 

Moved by Debra Burns, supported by Dawn Childers, to renew the OEFMP Fund Millage, at 1 Mill for 5 years.  Motion Unanimously Carried. 

 

C.    VFW Park Mowing – Needs to be mowed around the picnic area and trailer and the ball park.  Bid submitted asking $200 for the first mowing and $125 after that. 

 

Moved by Debra Burns supported by Larry Kennel to accept the bid asking; $200 for the first mowing, and $125 after that as needed.  Motion Carried.

 

 

9.       Cemetery:  Submitted Cemetery Committee Report.  Pre-pay for grave openings was discussed and sent back to the cemetery committee. 

 

Moved by Debra Burns supported by Larry Kennel to adopt the Right of Burial Certificate as presented.  Motion Carried. 

 

Moved by Debra Burns supported Larry Kennel to change the prices of spaces, lots, and grave openings as proposed in the Cemetery committee report effective May 17, 2006. (See attached listing)  Motion Carried. 

 

Moved by Debra Burns supported by Larry Kennel to adopt the changes to the cemetery policy dated August 17, 2005 to now read…

1.  No tents shall be erected between December 1 and April 1.  Services shall be conducted in the Mausoleum. 

2.  Reduced prices will be offered for sale of lots in older sections of the cemetery.  The price will be determined by the cemetery caretaker with a reduction of up to 50%.

3.  Buy back of cemetery lots and spaces and of mausoleum crypts and niches require proof of ownership (in the form of deed, receipt or right of burial document).  The Township will refund 50% of the original price paid.  A 90 day processing period is required before a refund will be issued.

4.  The original price paid for cemetery spaces will be credited to mausoleum spaces if someone wishes to trade burial places.

5.  As of May 17, 2006, 10% of lot sales will go perpetual care.

Effective May 17, 2006.  Motion Carried.

 

10.   Building Inspector’s Report:  Paul Wilcox submitted his report. 

 

11.    Attorney’s Report: The Township resident on Pennell Road needs 30 days extension on a 14 day notice to get rid of cars.    

 

12.   Other Business: A. Junk Cars

 

Moved by Steve Hoeksema supported by John Mulder, to instruct Attorney Davis to write a letter to Mr. Gass, to remove junk cars off his property.  Motion Denied. 

 

B.       Postage Meters – You can try free for 60 days then it is $19.95 a month.  More research needed. 

 

C.     Voting Machine – Auto Mark Machine used by disabled voters.  Cost covered by a Grant. 

 

Moved by Dawn Childers supported by John Mulder to approve the agreement for the Auto Mark ballot machine.  Motion Carried.    

 

D.     Fire Bill – Permission to not bill for fire call with a burning permit.

 

Moved by Dawn Childers supported by Steve Hoeksema, to absorb the fire bill with a valid burning permit.  Motion Carried.      

 

E.      M-53 Corridor Meeting – Larry Kennel and John Mulder attended and reported that there are plans to put in a left lane near Ross Road and Webster Road.  Also there will be a light at the Third street intersection.  Also the intersection at Bowers Road is being looked at for safety.

  

F.     MTA Banquet – Need to get tickets let Dawn know who is attending. 

 

 

G.     Ballot Language – Meeting to write ballot language will be Noon on Wednesday, May 24, 3006. 

 

H.    Signs – Portable signs on M-53 and M-21 are not allowed in the township. 

 

Moved by Larry Kennel supported by Debra Burns to forward notices to residents, on M-53 and M-21 with portable signs, of the ordinance and give them 14 days to remove them.  Motion Carried. 

 

13.   Public Time: A. Realtor signs on street corners – Not permitted in the Ordinance, and will be removed by the Road Commission. 

B.  Duckert – Concerned about a growing berm surrounding his property, and the legality of some actions taken by the development next to him.  Mark Samulson also has drainage concerns about the project on Bowman road. 

 

14.   Bills to be Paid: 

 

Moved by Debra Burns supported by, Larry Kennel to pay the bills of the general fund $11,267.83 the cemetery fund $3,093.76, OEFMP $140.00, and the permit fund $1,625.38, totaling $16,126.97.  Motion Carried. 

 

15.    Adjournment:
